Scope

Managing Deputy Commissioners are responsible for leadership of a distinct section, function, unit or area within the Department of Real Estate. They plan operations, develop staffing requirements, organize and direct the work of a group of employees and evaluate their work. They are responsible for or are involved in employee hiring, evaluation, training and discipline. They set goals, manage resources to meet these goals and report the results to management. They direct their operations within the context of the total Department and coordinate their work to meet overall departmental goals.

 

The four levels in this series cover a range from working supervisor to the highest non-CEA level.

Entry Levels

Entry into this series is typically through the journey level (Deputy Commissioner II, Department of Real Estate) in the Deputy Commissioner class series.

Factors Affecting Position Allocation

Level, variety and complexity of work, independence of action and decision, supervision received and degree of supervisory responsibilities, serve as differentiating factors between individual classes. The absolute size of staff (indicated in relative terms such as "large" or "very large") is not controlling in determining a�supervisor's position allocation if supervision of staff is accompanied by responsibility for consultation to top staff and responsibility for managing the work of staff performing a variety of specialized functions.

 

The other factors which enter into level determination (particularly in borderline allocations), insofar as they directly affect the Managing Deputy Commissioner's operation, are:

 

Variety of function and number of specialized functions supervised; complexity of functions; sensitivity of assignment; level and location of administrator to whom Managing Deputy Commissioner reports; responsibility for decisions made (impact of decisions on Department of Real Estate).

Definition of Levels

Managing Deputy Commissioner I

This is the first level in the Managing Deputy Commissioner series responsible for a small group of Commissioners and/or technical employees, or a large operations section. A Managing Deputy Commissioner I performs the most difficult, complex or sensitive work of the group.

Managing Deputy Commissioner II

Incumbents at this level supervise a small district office, a statewide technical function with professional staff, or a large operations section. Managing Deputy Commissioners at this level spend much of their time in supervision and management activities or handling complex contracts, cases and problems.

Managing Deputy Commissioner III

Incumbents at this level are responsible for a medium to large Department of Real Estate function in a major program area or a statewide technical function with a high level of sensitivity and public impact. Supervision is typically given through a Managing Deputy Commissioner I level.

Managing Deputy Commissioner IV

This is the highest non-CEA level responsible for the management of the Northern or Southern area or a major statewide technical or program operation in the Department of Real Estate. Supervision is typically given through a Managing Deputy Commissioner II or III.

Minimum Qualifications

Managing Deputy Commissioner I

Either I

 

One year of experience in the California state service performing the duties of a Deputy Commissioner II, Department of Real Estate.

Or II

 

Two years of experience in the California state service performing the duties of a Deputy Commissioner I, Department of Real Estate (Range C).

Or III

 

Experience: Three years of increasingly responsible experience in one of the following:

 

1. Sale or exchange of farm, residential and business properties. or

 

2. Negotiating for real estate loans in a bank, realty office, or savings and loan (requires extensive dealing with the public). or

 

3. Independent field investigative experience in civil or criminal law enforcement with a private or governmental agency. or

 

4. Performing the duties of an Escrow Officer in a bank, realty office, savings and loan, escrow or title company.

 

and

 

Education: Equivalent to graduation from college or equivalent degree (certificate) (diploma) approved by the California Superintendent of Public Instruction under the provisions of California Education Code Section 94310 with any major but preferably with specialization in real estate, law, finance, criminal justice, or public or business administration. (Additional qualifying experience may be substituted for the required education on a year-for-year basis up to a maximum of two years; however, in all cases, a minimum of two years of college is required.)

Managing Deputy Commissioner II

Either I

 

One year of experience in the California state service performing the duties of a Managing Deputy Commissioner I or Deputy Commissioner III, Department of Real Estate.

Or II

 

Eighteen months of experience in the California state service performing the duties of a Deputy Commissioner II, Department of Real Estate.

Or III

 

Experience: Four years of increasingly responsible experience, at least one year of which must be in a supervisory capacity, in one of the following:

 

1. Sale or exchange of farm, residential and business properties. or

 

2. Negotiating for real estate loans in a bank, realty office, or savings and loan (requires extensive dealing with the public). or

 

3. Independent field investigative experience in civil or criminal law enforcement with a private or governmental agency. or

 

4. Performing the duties of an Escrow Officer in a bank, realty office, savings and loan, escrow or title company.

 

and

 

Education: Equivalent to graduation from college or equivalent degree (certificate) (diploma) approved by the California Superintendent of Public Instruction under the provisions of California Education Code Section 94310 with any major but preferably with specialization in real estate, law, finance, criminal justice, or public or business administration. Managing Deputy Commissioner III

Either I

 

One year of experience in the California state service performing duties comparable to a Managing Deputy Commissioner I or Managing Deputy Commissioner

Ii.

Or II

 

Two years of experience in the California state service performing duties of a Deputy Commissioner II, Department of Real Estate.

Or III

 

Experience: Five years of increasingly responsible experience, at least two years of which must have been in a supervisory capacity, in one of the following:

 

1. Sale or exchange of farm, residential and business properties. or

 

2. Negotiating for real estate loans in a bank, realty office, or savings and loan (requires extensive dealing with the public). or

 

3. Independent field investigative experience in civil or criminal law enforcement with a private or governmental agency. or

 

4. Performing the duties of an Escrow Officer in a bank, realty office, savings and loan, escrow or title company.

 

and

 

Education: Equivalent to graduation from college or equivalent degree (certificate) (diploma) approved by the California Superintendent of Public Instruction under the provisions of California Education Code Section 94310 with any major but preferably with specialization in real estate, law, finance, criminal justice, or public or business administration. Managing Deputy Commissioner IV

Either I

 

One year of experience in the California state service performing the duties of a Managing Deputy Commissioner III.

Or II

 

Two years of experience in the California state service performing duties comparable to a Managing Deputy Commissioner I or Managing Deputy Commissioner

Ii.

Or III

 

Experience: Broad and extensive (more than five years) of increasingly responsible experience, at least three years of which�must have been in a supervisory capacity, in one of the following:

 

1. Sale or exchange of farm, residential and business properties. or

 

2. Negotiating for real estate loans in a bank, realty office, or savings and loan (requires extensive dealing with the public). or

 

3. Independent field investigative experience in civil or criminal law enforcement with a private or governmental agency. or

 

4. Performing the duties of an Escrow Officer in a bank, realty office, savings and loan, escrow or title company.

 

and

 

Education: Equivalent to graduation from college or equivalent degree (certificate) (diploma) approved by the California Superintendent of Public Instruction under the provisions of California Education Code Section 94310 with any major but preferably with specialization in real estate, law, finance, criminal justice, or public or business administration. Knowledge and Abilities

All Levels:

Knowledge of: Provisions of the California Real Estate Law, the law governing subdivided land, the Subdivision Map Act, related legal opinions and court decisions; Department of Real Estate programs, policies, rules, regulations and procedures; methods, practices, and�procedures controlling the subdivision of lands and the sale, purchase, exchange, or lease of real property; investigative methods, California laws related to evidence, criminal and administrative procedures; laws, rules, regulations and policies governing the issuance of Real Estate licenses; principles of personnel supervision, development, training and management; the administration and departmental goals and policies; Department's Affirmative Action Program objectives; a manager's role in the Affirmative Action Program and the processes available to meet affirmative action objectives.

 

Ability to: Interpret and apply provisions of the California Real Estate Law and the laws governing subdivided lands, related legal opinions and court decisions, and departmental policies, rules, and regulations; plan, organize, and direct the work of subordinates; gather and analyze data and present ideas and information effectively and edit written reports; establish and maintain project priorities; gain and maintain the confidence and cooperation of others; effectively contribute to the Department's affirmative action objectives.

Managing Deputy Commissioner IV

Ability to: All of the above, plus administer a major program, geographical area or statewide technical function in the Department of Real Estate.

Special Personal Requirements

All Levels:

Demonstrated ability to act independently with flexibility and tact.

 

Some positions: Willingness to travel.
