330. Compelling Management Need

Subject to the SPB Rule 442 and Government Code Section 19050.8, temporary assignments may be made to meet urgent and nonrecurring program or departmental needs of limited duration that have a broad and significant impact on departmental operations and efficiency.

  1. These assignments may only be made with the voluntary consent of the employee. Employees placed on temporary assignments (normally 24 months or less in duration) to meet a compelling management need must remain in their current classifications. However, unlike Training and Development assignments, no limits are placed on the employee’s ability to perform duties which are at a level above or below the employee’s class of appointment. Therefore, the duties and responsibilities may vary from those of the employee’s classification. Since assignments can only be made with the voluntary consent of an employee, out-of-class claims may not be filed.
  2. SPB Rule 442 requires departments to provide notice to DPA any time a compelling management need assignment is made. The reason for the notice is to ensure that DPA is aware of such assignments, since these are exceptions to the classification plan. DPA approval of such appointments is not necessary. Notification to DPA should take place within 30 days of the compelling management need assignment.
  3. DPA notification for compelling management need assignments should include the following information:
    • A description of the management problem which required that the compelling management need assignment be made.
    • Name and current classification of employee.
    • A general description of the duties to be performed. If being assigned to an existing position, also include the working title and the classification of the position.
    • “From” and “To” dates of the temporary assignment.
    • An organization chart showing the organizational placement of the position/employee.
  4. The notification to DPA is filed in the department’s “Unique Position Allocations” file with a request that the file be recalled to the CCD department analyst on the expiration date of the temporary assignment.
